Obtaining a Simple Accommodation Tourism Business Certificate has become mandatory... Who has to obtain this certificate?

Except for accommodation facilities with a Tourism Management Certificate, other accommodation facilities that are in operation and have a Workplace Opening and Operation License from the relevant administration are obliged to obtain a Simple Accommodation Tourism Management Certificate by the Ministry within the scope of the Provisional Article 11 of the Tourism Encouragement Law No. 2634, which entered into force on 28.07.2021.

The Ministry of Culture and Tourism issues Tourism Management Certificates to tourism facilities operating in the tourism sector, which are granted a Business License by the municipality in the province where the facility is located, and which request certification by the Ministry of Culture and Tourism.

Except for accommodation facilities with a Tourism Management Certificate, other accommodation facilities that are in operation and have a Workplace Opening and Operation License from the relevant administration are obliged to obtain a Simple Accommodation Tourism Management Certificate by the Ministry within the scope of the Provisional Article 11 of the Tourism Encouragement Law No. 2634, which entered into force on 28.07.2021. 

It lasts for one year

Within one year from the date of entry into force of this article, accommodation facilities that are operating with a Business License and do not have a Tourism Management Certificate are required to apply for a Simple Accommodation Tourism Management Certificate.

Accommodation facilities that obtain a Tourism Management Certificate within the same period are not required to obtain a Simple Accommodation Tourism Management Certificate. Accommodation facilities that do not apply within the given period will not be able to operate. These facilities will have their workplace opening and operation licenses revoked by the competent authority within one month and their activities will be terminated.

How will the inspection of facilities requesting or holding a certificate be conducted?

The procedures and principles regarding the certification of simple accommodation facilities were determined within the scope of the 'Regulation on the Certification of Simple Accommodation Facilities and Beach Businesses' published in the Official Gazette on 21.09.2021.

Based on Article 5 and Provisional Article 11 of the Tourism Encouragement Law No. 2634, this regulation regulates the nature of the Simple Accommodation Tourism Management Certificate, the information that must be included in the certificate, the principles regarding the application and issuance of the certificate, the principles regarding promotion, information and price tariffs, inspection and sanctions to be applied.

The inspection of the facilities requesting or holding a certificate will be carried out by the personnel of the Provincial Directorate authorized by the governorate, and in the absence of sufficient personnel, by other personnel to be assigned by the governorate.

What will be included in the Simple Accommodation Tourism Business Certificate application petition?

The application petition for a Simple Accommodation Tourism Business Certificate is attached to the Regulation on the Certification of Simple Accommodation Facilities and Beach Businesses. This petition includes information on the real or legal persons making the request and the facility. The applicant who wishes to apply for this certificate must fill out the petition form and submit the petition together with the opening and operation license, the current address of the facility and the opening and operation license.

If the address specified in the license is different, the applicant must submit a letter stating the current address, and if the applicant is a natural person, a signature declaration to the Provincial Directorate of Culture and Tourism physically or electronically. The capacity of the accommodation facilities whose application documents are deemed appropriate will be determined on site and a Simple Accommodation Tourism Management Certificate will be issued with the approval of the governorate. In the calculation of room and bed capacity, each bedroom is considered to have two beds.

Who has to obtain this certificate?

Before 28.07.2021, the facilities that have obtained a license to open and operate a workplace must obtain a Simple Certificate if they cannot obtain a hotel (1,2,3,4,5 stars), holiday village (4,5 stars), motel, apart hotel, pension, private accommodation facility and boutique hotel certificate issued by the Ministry Tourism Management Certificate specified in the Regulation on the Qualifications of Tourism Facilities.

A simple certificate cannot benefit from the investment incentives and alcohol license advantages provided in the tourism management certificate. Facilities that receive a simple certificate cannot receive a Yellow Plaque. The fee for a simple certificate has not yet been determined by the Ministry.
